To the Editor:

Recent events in a Lee County move away case is disturbing, but not unexpected. Reportedly, the court is allowing a father’s children to be moved thousands of miles away in contradiction to the law. The Alabama Parent Child Relationship Protection Act states explicitly that such a move “is not in the best interests of the child”. “The best interests of the children” is the ubiquitous standard to which the court is to adjudicate. The court does not act in the best interests of the children, thus the court’s actions are not unexpected.

A father having custody is an extraordinary event. Indeed, death is the only way a child, abused by his mama, will have relief in the Great State of Alabama. For example, the court has given custody to a mother whom it found beat her child into a coma causing permanent brain injury. The law states explicitly that it is not in the best interests of the child for the abuser to have custody. The father in the this case will never forget walking into the emergency room to see his beloved child having bruises forming a handprint the child’s face. As an added insult, the court told the father that proper medical care is not important for the child’s well being, yet ordered the father to make sure the child gets proper medical care. In other words, it is not in the best interest of the child to receive proper medical care.

The appellate court affirmed the court’s decision to give custody to an abusive mother, yet in another case stated an unsubstantiated accusation was enough to remove custody from a father.

There are thousands of similar stories throughout Alabama. The only way to bring justice to Alabama is accountability in the courts, with severe sanctions for jurists who stray from statutory law.

It seems like some judges in family law courtrooms in Alabama would rather be politically correct instead of legally and morally right.
