At the post entitled "Critical Mass: Censorship at Roger Williams", Critical Mass points out that while some speech is ridiculously offensive (especially some speech aimed at me), nevertheless, it is unconstitutional to suppress ridiculously offensive speech. I wonder if Roy J. Nirschel has ever seen standup comedy. Standup comedy offends everybody, thank goodness.
I know, I know, institutions of higher learning are different from comedy clubs because students at comedy clubs are usually more sober than students at other places. BUT THAT'S NO EXCUSE!
In the post entitled "Jack Bog's Blog: Devil's in the mailbox", Jack hits the nail on the head for why people tend to vote for anti-tax ballot measures like 5 and 50 win by wide margins.
Here in Washington County we have a number of folks who are retired and are on fixed incomes. We also have a number of folks who are unemployed. Most of these folks don't want to be perceived as not caring for schools or needed government services, but from what I hear, they have perceptions that much of the money collected by government is spent on rich folks' toys; that tax money is wasted by incompetent bureaucratic managers; that tax money goes for outrageous salaries for middle and top management of the various bureaucracies, etc., and these perceptions make them distrust government and the government's ability to properly spend the money it has.
As Jack points out in his post, some of the stunts pulled by various government bureaucracies just piss people off!

Donald Sensing has posted an opinion about Lilek's tirade about the leaked Rumsfeld memo. It's causing quite a stir so head on over there and join in the discussion, but remember, no profanity.

The following is an excerpt from Lilek's tirade:
But in another respect, the memo gives you a sick sinking feeling. Why do we need to be asking these questions now? Shouldn’t these things be obvious? And of course they are to Rumsfeld, but not to many in the great immovable bureaucracy that apparently regards national defense as a 9 to 5 job whose purpose is a pension, not the survival of liberal democracy. You’d like to think that everyone in the Defense establishment has walked at a quicker pace in the last two years. Taken shorter lunches. Cut to the chase. You’d like to think that from the janitor to the Joint Chiefs, the mood was simple to describe: urgency.
I disagree with with the above excerpt. The memo shows that Rumsfeld is asking questions that should constantly be asked over and over, regardless of one's perception about what is static or what is not.
Rumsfeld is prodding his subordinates to think of various scenarios and see if there's a better way of accomplishing things. He's questioning the status quo and exhorting others to "think outside the box". Rather than giving me a sinking feeling, the memo shows me that a creative thinking process is going on which I think is good.
I'll admit in any bureaucracy there is deadwood, but this is normal for bureaucracies and to slander all pentagon workers is wrong. As a person who was in the Navy, believe me, there were plenty of times when we thought the Navy bureaucracy was there only to make life difficult for the sailors at sea, but we also knew not everybody in the Navy bureaucracy was incompetent deadwood.
It is the job of the civilians in control of the military to prod, exhort, make necessary changes, bug, nag, bitch at, and order changes to the military bureaucracy. We live in a country where civilian control of the military is absolutely essential in order to maintain freedom and Walmart's perquisite to hire illegal immigrants and pay them a substandard wage.
The military bureaucracy is not there to take over a situation and make changes without the supervision and input from the civilian leaders. The military bureaucracy is not supposed to make policy and then act on it. That is the job of the civilians in control of the military. While I don't agree with everything Rumsfeld has done at least he's done something and is willing to look at alternatives. That is what we want in a Secretary of Defense.
As for the leaking of the memo - it's no big deal. Whether or not the memo leaked the Democrats would still be bitching, whining and complaining about every little thing Rumsfeld has done or will do. When it comes to the Democrats, Rumsfeld is "damned if he does and damned if he doesn't".
But that's ok, too, because the Democrats are the major opposition party, they're out of power and I guess you could say it's their job to engage in mindless hyperbole. After all, the Republicans did it when Clinton was in office even going so far as trying to impeach Clinton for being a liar and sleazy. Jeez, if we impeached every president who at one time lied and was sleazy, we'd be so busy impeaching that we would never get anything done. The impeachment process is basically a political process, anyway. If you don't believe me, just ask Frank.
CrimLaw points to a story about a feuding judge and prosecutor which, apparently, causes unexpected dismissals happening in such a way as to *chagrin some defense attorneys. The following is an excerpt:
Pittsylvania County Commonwealth's Attorney David Grimes stepped into Judge B.A. "Monk" Davis' courtroom May 23 and delivered a figurative punch in the mouth. In an act of open distrust, the prosecutor requested that juries, rather than Davis, decide his cases that day.Davis asked why, and Grimes told him, bluntly, "My determination is based on a lack of confidence that Your Honor would be willing to strictly follow the law."
By the end of the docket, barely a case had been tried. Davis dismissed many of the charges, including one against a convicted murderer charged with possession of a firearm.
Within weeks, Grimes and his assistant, Bryan Haskins, found themselves facing contempt of court charges for attempting to "hinder or obstruct the Court in the administration of justice."

I guess I should preface this post by saying I'm reluctantly pro-choice. At the following post by XRLQ there is a discussion going on about the constitutionality of the partial birth abortion ban. I don't think the legislation will be upheld in the courts, but I'm not a lawyer so my opinion is merely that of an interested layman. By the way, while I'm reluctantly pro-choice, whenever anybody (not too many people do) asks me if a person should get an abortion or not, I always say they shouldn't. However, I definitely don't think abortions should be outlawed.

This election has everything except Britney Spears walking around half naked.

Mr. SMITH. Mr. President, I rise today to speak about the need for hate crimes legislation. On May 1, 2003, Senator Kennedy and I introduced the Local Law Enforcement Enhancement Act, a bill that would add new categories to current hate crimes law, sending a signal that violence of any kind is unacceptable in our society.
I would like to describe a terrible crime that occurred in my own backyard in Portland, OR. Early in the morning on Sunday, September 21, 2003, two men who identified themselves as skinheads, stabbed one African-American man and threatened another with a gun. Sadly, these two racially motivated crimes were committed by young men_both in their early twenties_with hate in their hearts.
I believe that Government's first duty is to defend its citizens, to defend them against the harms that come out of hate. The Local Law Enforcement Enhancement Act is a symbol that can become substance. I believe that by passing this legislation and changing current law, we can change hearts and minds as well.

It is a creature of their own will, and lives only by their will.” Just for effect, try substituting the word “will” with “knowledge”, and you’ll soon understand the stakes involved. A brief look at the National Constitution Center’s (NCC) survey on America’s constitutional knowledge gives cause for concern. For example, a whopping 62% of U.S. citizens were unable to name the three branches of the federal government. Even more shocking, one-third of all respondents were unable to name even one.

Lawyer died in bid to save co-workersOne of the last things John Slater apparently did before he died in a locked and smoky stairwell in last week's Loop high-rise fire was reach for a manual to see how to lead his co-workers to safety.
"If necessary to leave the building -- do not use elevators -- use the emergency stairwells and close all doors behind you," read the instructions in the case of a fire.
That's apparently what Slater -- an attorney for the Public Guardian's office -- and several other people did when the blaze broke out at 5 p.m. Friday.
But the intensely hot blaze sent waves of smoke through the stairwell, and the doors leading to fresh air had automatically locked, trapping Slater and the others.
Some two hours later, they were found in the stairwell near the 20th floor.
Isn't free enterprise wonderful? Although, I'm not too sure FBI agents should engage in it until after they retire.
Accuracy In Media - Media Monitor - Catching Chinese SpiesA strange story out of Phoenix, Arizona, might explain some of the difficulties the Bureau has had catching Chinese spies. The Associated Press’ John Solomon recently reported that the Justice Department is looking into allegations that some FBI agents have profited from counterintelligence and counter-terrorism investigations. The department’s Inspector General, according to Solomon, is examining the business dealings of several agents from the FBI’s Phoenix Field Office. Solomon reported that court documents allege that some agents and their "assets" were doing business deals with China at the same time the Bureau was investigating China’s illegal acquisitions of sensitive technologies.

Cobb has an interesting post about demand side bidding concerning power companies. Here in the Northwest we have the Bonneville Power Administration (BPA). The Northwest Power and Conservation Council has presented some recommendations to the BPA because BPA intends to augment its power supplies by 800 to 1,000 average megawatts (aMW) to meet expected loads during the 2002 – 2006 rate period.
The following are just some of the recommendations:
Overall ApproachIt is recommended that Bonneville use the "Middle Ground" approach described in the Issue Paper. The pertinent features of this approach are as follows.
Bonneville should strive to acquire conservation for as little as it can while still meeting its goal. It should not employ an explicit rate-impact test. Doing so could, in some circumstances, disadvantage Bonneville in negotiating what it will pay for conservation and, in other circumstances, could result in very cost-effective conservation going undeveloped.
What it is willing to pay for conservation savings should be based on the market value of the saving produced. Because market prices exhibit much more seasonal and daily variation that in the past, the time at which savings are produced should be reflected in the value. Similarly, where there are variations in value due to geographic location, those values should also be taken into account and captured by the Power Business Line if possible.
Bonneville's should be willing to acquire conservation that would produce savings beyond the 2002-2006 period. However, if customers choose not to contract with Bonneville beyond that period, they accept the responsibility for any costs not yet recovered or savings yet to be delivered to Bonneville.
The conservation acquisition is intended to reduce the necessity for market purchases of power. Therefore, it will be necessary for customers that purchase other than load-based products from Bonneville (e.g. a block purchase) to commit to reducing their purchase from Bonneville in the amount of the saving to be produced by Bonneville-funded conservation.
Conservation TargetThe conservation target proposed in the issue paper was determined by allocating the regional resource potential on the basis of the percentage of loads estimated to be served by Bonneville in the 2002 – 2006 period. Comment was received to the effect that the allocation overlooked the pre-subscription loads served by Bonneville and did not include the full responsibility for IOU residential and small farm loads. Inclusion of these factors would tend to increase the amount allocated to Bonneville. At the same time, Direct Service Industry loads were inappropriately included in determining the allocation when the regional conservation potential does not include an estimate of conservation potential in the DSIs. These recommendations reallocate the regional target to Bonneville according to the revised load estimates and estimating a separate target for the DSIs.

At these meetings it was decided that Oregon would lead the way with a socialist agenda that culminated in Oregon Shines, Benchmarks Goals 2000 programs that affect every part of every life for Oregonians. Kitzhaber said "the state is the parent of the child, and the parents are part of the problem" in meeting the state goals, and the state is going to take the children and force parents into contracts, so that federal funds can be used to provide services that the parents cannot afford "in the best interest of the child".
In the last ten years, all kinds of programs have been implemented "co-operative public safety agreements" "community policing" "safety and security" "protection and intervention" "potential abuse" "best in interest of the child", and our constitution has been altered to allow excessive state intervention in all levels of Oregonians lives.
In l995 the state became aggressive in funding more jails, mandatory sentencing, changing the definitions of abuse and neglect and lifting the burden of proof of crime to remove children and incarcerate innocent people, as well as legislation to criminalize debtors. In l997, the Cato Institute gave Kitzhaber an "F" as the worst governor in the US for a 40 % increase in spending as he and the legislature flooded the agencies with the largest budgets ever to implement the police state agenda.
In l997, President Clinton aggressively picked up the now tested programs and turned them into National programs to take more children, restrict, criminalize and incarcerate more and more innocent people, with an agenda of destroying the families, controlling the children through the schools, all part of the Goals 2000 programs. These programs have federal incentives to exploit the vulnerable, without whom the programs could not exist.
This year, Clinton has written executive orders to allow the same no due process courts as were started in Oregon now to be international, with the newly created Statutory World Court, like the WTO a secret, unelected Court, to have jurisdiction over Americans.
In light of this history, and as Police Chief Howland is jumping ship as this agenda is coming to light, we find the state courting a Chief who, according to Mayor Vera Katz website is a former United Nations International Police Deputy Commissioner, is currently on the US-Israeli "Anti-Incitement Committee"; formerly a deputy of the International Police Task Force in Bosnia and Herzegovina. He has a masters degree in international public administration and is stated to have "strong international ties" in the articles. He is quoted as saying that "Policing is all about making people safe and making them feel safe...The police officer of today and tomorrow is a problem solver, psychologist, social worker, and yes, sometimes a gunfighter"....
Mr. Kroeker was brought in to head the San Fernando Vallery Police ten days after the Rodney King videotape came to light, and in l997, according to the Oregonian, and African American sergeant wrote to the Los Angeles City Council that "Kroeker failed to punish white officers who mistreated African American police under his command."
At this time the Los Angeles Police Dept is involved in he largest corruption scandals in the departments history, and Mr. Kroeker comes to Oregon having had his career in the upper ranks of that department. Kroeker was twice overlooked for Los Angeles Police Chief; the LAPD has over 9,000 sworn officers, and Portland has around l,000.
A Los Angeles attorney Stephen Yagman is quoted; "Mr. Kroeker is a very, very political, slick cookie, who is a master of propaganda...the reason rank and file support him stems from the fact that if he were in a position to rule on complaints of misconduct, he would do right by the cops."
The major players in the "Battle of Seattle" are the mayor and the chief of police, and unless you want an international agenda to solidify, citizens better speak out because soon we will not be allowed. John Kitzhaber and those furthering these goals are puppets for the much larger goals, as is Clinton, and these are the actors put in place to accomplish complete control. The authority of the people has been usurped, as well as the constitution in Oregon in the last ten years, directly. In l986 it was decided that Oregon would be the place to find out how far the people can be pushed before they revolt or sell out their freedom and their posterity to slavery and Marxist socialist state control.
WAKE UP AMERICA - The reality is that we have been under Martial Rule in courts of no due process for many years, with the media controlled by the same state agenda not to print the peoples side, only the state view without accountability. Now the Martial Rule is aggressively moving into the streets .... don't believe the deception and fraud of the government or the media half truths; the words are not what they seem and we cannot allow these programs to become entrenched any further. Citizens are saying NO to unjust rules, and NO to treasonous and biased judges and seeing the blatant intent of corrupt elected officials. People are seeing the extortion and profiteering, mismanagement and unaccountability from Kitzhaber on down with federal and state money. Rooting out the "good old' boys (and girls) club", will clean up the fraud in Oregon government.
Now that the people see this, and stop this here, just as it started here, we stop this nationally and we grind the gears to a halt of this greedy rendering machine that is fed by exploitation of innocent people world wide.

What the companies didn't say, however, was that they were preemptively collecting fees for a service that would not be available for another 23 months. What's more, the companies were charging the new fees with the full knowledge and approval of the Federal Communications Commission, the government agency that is supposed to look out for the public on telecommunications issues.
One Hand Clapping points out in his post that sports stadiums don't benefit anybody but an elite few. His post is relevant because here in Oregon the gov recently signed into law funding for a new stadium. I like sports but it seems like nowadays you have to have a lot of moolah just to be able to watch a game in person.
I don't know what the solution to the problem is, or even if there is a solution. I suppose there is no problem if you're one of the elites.

According to the Associated Press, the Baltimore police concluded that Erickson's girlfriend Lisa Ortiz: initiated the fight by hurling objects; decided to come back twice after Erickson carried her out of the apartment; repeatedly kicked the apartment door; caused Erickson two minor injuries, one of them to his pitching arm; and herself suffered no injuries.Nonetheless the police, who were operating under Maryland's mandatory arrest law, interpreted Erickson's actions as excessive and are charging him with second-degree assault. Ortiz states that Erickson, who did not pursue her either time after carrying her out, "has never been physically abusive toward me, and in no way do I feel threatened or felt fear from Scott." Ortiz was not arrested.
Domestic violence activist Greg Schmidt, a police lieutenant who created the Seattle police department's domestic violence investigation unit in 1994, says that cases like Erickson's demonstrate the way men are often presumed guilty in domestic disputes. He notes that mandatory arrest laws, such as California's, frustrate police officers because they are "expected to make arrests in petty incidents, often where the woman is the aggressor, the abuse is mutual, or it is unclear who the aggressor was."
"The domestic violence industry--the trainers, the shelter directors, etc.--can spin things however they want," he says, "but most street cops know that women are just as likely to start domestic disputes as men are. But arresting women puts you under lot of scrutiny. It's bad for your career."
Schmidt also criticizes the dominant aggressor doctrine which discourages dual arrests (which are often an appropriate measure) and instructs police to downplay who struck the first blow. Instead, police are asked to focus on who is (supposedly) in control of the situation and who is more fearful--often code words for "arrest the man."
The sentence below from the above excerpt sort of tells it all. Political Correctness has become so ridiculous that now arresting the real criminal is bad for a cop's career.
But arresting women puts you under lot of scrutiny. It's bad for your career.
The good news is that the charge was dropped.

The murder of Lorenzo has all the marks of an attack by the morons in the Voodoo Christianity Cult, down to and including the vehicles used and the ability to communicate with each other in order to clean up a lot of the evidence of the murder.
It seems for many years the cult has been moving a lot of its Oregon operations to Washington County. It has increased its concentrations of members (many of them retired white folk) in Beaverton, Hillsboro, Sherwood and Forest Grove.

On September 30, l999, in Marion County, Oregon, an outraged group of citizens placed judge Fred E. Avera under Citizens Arrest for Trespass of Treason to the Constitution and Misprison of Felony. Witnessing this arrest were court watchers from A Voice For Children, Oregon Judicial Watch, Constitutional Defenders and Grandparents Rights groups who have been actively confronting the corruption in the Oregon judicial system.
Among the court watchers were l998 Reform Party candidate Roger Weidner, candidate for Secretary of State Carlos Luceros, Director of F.A.I.R. Velma Hartwig, and Oregon Judicial Watch President Pamela Gaston, and 20 supporters.
Wilbur Russell Gaston was in the Marion County Courthouse in a trial with no jury to terminate parental rights of his ten year old daughter Melissa The OREGON OBSERVER has covered in previous issues the outrageous treatment of Wilbur Gaston, his ten year old daughter Melissa Gaston and his wife Pamela Gaston by corrupt judges, attorneys, SOSCF personnel and other public officials. Over the past three years the Gastons have proven in court: How Melissa Gaston was sexually molested in more than three of the
eighteen foster homes she has lived in, burnt as punishment in one of the foster homes; How on the orders of SOSCF employee Larry Lawson a movie was made of Melissa dancing nude, sexually manipulating herself, by foster mother Hazel Spees; How Wilbur and Pamela Gaston have been repeatedly arrested and jailed for attempting to expose the criminal conduct of the judges, SOSCF officials, and others, who have been sexually exploiting Melissa Gaston.In an earlier edition, the OREGON OBSERVER reported that in April, l998, a Marion County Jury, hearing a criminal contempt charge against the Gastons, not only found the Gastons "not guilty" but found that certain Marion County judges, SOSCF personnel and other state officials, were conspiring against the Gastons. From all the informed people, the OREGON OBSERVER has talked to about this case, it has become apparent that the reason the STATE wants to terminate Gaston's parental rights, is to keep Melissa quiet, to keep Melissa from telling, in her own words, how she has been sexually abused while in the STATE foster home program.
On September 30, l999, judge Fred E. Avera (Polk County) was presiding. In a previous hearing, before judge Avera, the Gastons had moved for a summary judgement on a Racketeering Complaint the Gastons had filed against the judges, SOSCF employees, and other public officials.
In the earlier case the Gastons argued that a jury had found them not guilty because they had been the victims of a conspiracy involving the judges, SOSCF employees and other public officials. In the earlier case, the Gastons argued since the jury found the judges conspiring, in the criminal case, the Gastons were entitled to a summary judgement on that same issue in the pending Racketeering case. In that earlier case when judge Avera ignored the facts and ruled the Racketeering claim "frivolous", the twelve Gaston
supporters present got up and walked out of the courtroom in disgust.On September 30, judge Avera first heard from the attorneys for the STATE, who were present to quash all of the subpoenas that the Gastons had served on Governor Kitzhaber, Attorney General Myers, and Chief Justice Wallace Carson and other STATE officials. Kitzhaber, Myers and Carson were subpoenaed because they hae knowledge of the STATE abuse of the Gastons for more than two years, and have refused to take action to stop the abuse.
Judge Avera then asked Wilbur Gaston if he had anything to say..... Gaston then stood up and for fifteen minutes read a prepared statement setting forth the criminal behavior of the judges, SOSCF employees and public officials, in covering up, in sham hearings, the sexual abuse of his 7 year old daughter, Melissa, while she is in the custody of SOSCF. Two of Gastons supporters then stood and stated, on the record, that judge Avera had committed Trespass of Treason to the Constitution and numerous other criminal acts, while hearing the Gastons cases.
Gaston turned and addressed the Bailiff. "You have heard more than two people in open court, under the Constitution of the United States, charge judge Fred Avera with Tresspass of Treason to the Constitution. "You must remove this man from the bench. If you do not remove this man from the bench, you have violated your oath of office and are as guilty as he is, of committing Trespass of Treason to the Constitution and Misprison of Felony".
Gaston then read the relevant portions of Article 18, Sec. 4, of the United States Code "whoever having knowledge of the actual commission of a felony, cognizable by a court of the United States, conceals and does not as soon as possible, make known the same to some judge or other person in civil or military authority, under the United States, is guilty of the federal crime of Misprison of a Felony".
Gaston then turned to the Bailiff again, and said, "will you interfere if I perform a citizens arrest on this man? I will not subject myself to be arrested performing a citizens arrest, as is my Constitutional Right, but on the record, in open court I am placing MR.AVERA under citizens arrest for the c rimes of Trespass of Treason and Misprison of Felony, here before God and my fellow State Citizens of the Republic of Oregon. AS GOD IS MY WITNESS THIS CORRUPTION STOPS NOW." Gaston declared, pounding on the table, in outrage.
As Gaston spoke, Assistant Attorney General Ted Meese, State appointed Attorney for Melissa Gaston Richard Condon, SOSCF caseworker Larry Perton, Assistant Attorney General for the SOSCF Staci Barry, Assistant Attorney General Trial Attorney Cynthia Botsios, and Assistant Attorney General for the SOSCF termination specialist Dina Vitolins, sat silent and red faced. Also in the court as Gaston spoke were the Marion County Sheriffs deputies Poston, Papenfus, Daley, Schultz, Olson, McMullen and Stai.When Avera threatened Gaston if he didn't stop talking he would be removed, Weidner had all the supporters stand in support of Gaston. As Gaston finished his statement of arrest of judge Avera, Weidner told the supporters to leave the court, that Avera was conducting sham judicial proceedings where the outcome was a foregone conclusion.
As Weidner was leading the supporters out of the courtroom, Lt Sgt. McMullen was holding the door and made a sarcastic remark to Roger Weidner, who then reminded McMullen that he is a public employee. As Weidner was nearing the front door, he turned and told his supporters to get the names of the guards present. McMullen approached Weidner, white faced with his handcuffs held in his left hand, shoulder high, ready to strike.
McMullen then Yelled at Weidner "I am telling you to get the hell out of this building". Weidner responded "this is a public building, McMullen. I am leaving, but I will leave when I want to".
As soon as Weidner spoke, McMullen violently grabbed his left arm, pushing him down, snapping on the handcuffs hard enough to leave red welts on Weidners wrists.
As McMullen was manhandling Weidner, he snarled "I am getting sick and tired of you Weidner". As Weidner was being taken to jail, he said to McMullen "you are making a big mistake, McMullen!" McMullen responded sarcastically "you really scare me, Weidner!".
This is not the first or even the second time that Dave (the THUG) McMullen, has attacked concerned citizens, court watchers who have been fighting the corruption in the Oregon court system. On March l9, l998, Gaston supporter and Family Freedom Press Editor DottiAnn Blakemore, a 50 year old church secretary and family rights advocate, was violently attacked by McMullen after she spoke in court to Gaston, who was being arraigned on a contempt of court charge. Gaston had been brought in shackled, and after Mrs. Blakemore said "we love you Will", McMullen attacked her and drug her screaming f rom the courtroom. McMullen and other sheriffs drug Mrs. Blakemore around the courthouse for 45 minutes with her clothes around her ankles, torturing and abusing a woman with impaired health and arrested her for criminal tresspass.
On April l6, l998, Pamela Gaston went to the Marion County Courthouse to get judge Ertsgaard's signed order to protect Pamela and her nine year old son Kevin from the SOSCF retaliation. Judge Paul Lipscomb had earlier issued a memo barring Pamela from the courthouse. While Pamela was in Ertsgaards office, she had been followed in by McMullen, and told to get out of the courthouse immediately or she would be arrested. Pamela told McMullen she would leave as soon as she got the judges order. As Pamela approached Ertsgaards doorway, McMullen violently attacked her, threw her to the floor and maced her. It is outrageous and the OREGON OBSERVER condemns Marion County for allowing armed thugs like Lt.Sgt. Dave McMullen to continue to attack innocent citizens of this state who are fighting to restore Constitutional Rights to the citizens of this state.
The arrest statement is printed below, and two concurred that judge Avera is guilty of the crimes of Trespass of Treason to the Constitution and Misprison of Felony. This document, signed by thirteen people, now is in the hands of an office in the Pentagon of Military Authority to defend the Constitution under federal laws to prosecute this
judge for CONSTRUCTIVE TREASON.Editors Note: The Gastons and courtwatchers left the courtroom after arresting judge Avera and charging him in open court on the record. Avera immediately quashed all Gastons subpoenas, denied all Gastons motions, allowed previously discredited witnesses and perjured testimony that has been discredited in past hearings on the record, and unlawfully terminated parental rights of Wilbut Gaston, and stated that Melissa will be adopted out, as was a foregone conclusion that he would, as every ten other judges have before him. No matter what the STATE presents, it gets protected by corrupt judges acting in the best interest of the STATE regime. The Gastons have been told that Melissa has already been adopted out, before parental rights were terminated. All actions of the court are void, and will be dealt with in the Ninth Circuit Court of Appeals, where the rest of the Gastons cases are now pending.
The Gastons, in a press release two days ago called the "Killing Floor", described every detail of how the sham proceedings and Alice in Wonderland Court take the children from the families without due process.
The court, and Avera followed their script to the letter in this hearing. After the termination was decided, a wave of fear swept the courtroom. Court watchers reported that counselor Nancy Link, who has vacated her office without a forwarding address in the last month, requested armed guard to leave the courthouse. The other members of the court spoke to each other of being in fear for their lives, not of Wilbur Gaston, but of the people who are affiliated with him. Finally these criminals and perverts are realizing that they cannot make this go away by destroying Will Gaston and his family, and now the public outrage is a rising tide.
The people are demanding their constitutional rights and accountability, now that they see how the SOSCF operates in these corrupted courtrooms. The Gastons case has exposed and documented the practices of concealing all evidence of STATE abuse as they routinely sexually abuse the children in foster homes and cover up these acts, and protect the criminals, to prevail in taking children from their families and profiting from this.

Under Title 18, USC, Sec 4, I wish to report to the court that you, sir, have committed trespass of treason to the Constitution, by you denying us access to said Constitutions, denying us the rights protected by the Constitutions Article 3, Section 3, clause 1...
You are guilty of Depriving a free, white man, State Citizen of Constitutional Rights of ORIGINAL Article 7 of the Oregon Constitution;
where "in all controversies a trial by jury shall be preserved"By obstructing justice with bias and prejudice to protect yourself, the STATE OF OREGON and fellow bar members from criminal exposure;
By failing to protect a child while being kept in unlawful STATE incarceration, criminally abusing, aiding and abetting child sexual abuse and conspiring with other STATE OF OREGON agents and authorities to destroy my daughter and my family;
By conducting a court of unknown unconstitutional jurisdiction, using Statutes against a free, innocent State Citizen; using unconstitutional 4l9 "juvenile code" statutes to deprive me of my inviolate rights . You cannot regulate a human being.
By conducting a court, to quote you "you are in juvenile court - there are no charges, there are no defendants, there are no juries" and to proceed against an actual parent, and sever the natural bond of the family body, having never charged me with a crime or convicted me of a crime, is an unconscionable violation of my due process of Law.

By allowing the STATE to prevail with complete disregard for undisputed court testimony - sworn confessions and a jury verdict that you are, along with other judges, committing fraud and treason in open court against the Citizens of the State of Oregon, as well as my daughter and myself.
By using hearsay and previously discredited reports and witnesses whose lies
were dismissed in open court in November, l996, when the case was exposed as
lies and fraud, and the original petitions were dismissed.By refusing to uphold subpoenas of critical adverse witnesses to be cross examined, even quashing the subpoena of Dep District Attorney William Howell, whose fraudulent, malicious, discredited, dismissed petitions have been holding Melissa for three years unlawfully.
You have refused to uphold your oath to the Constitution and have intentionally and maliciously deprived me of fundamental rights and liberties guaranteed by the Constitution to be free from excessive government intervention and criminal STATE abuse.
By refusing to answer all questions as to venue and jurisdiction. I cannot defend myself if I do not know what venue and jurisdiction I am in, and you refuse to make this clear to me. .Jurisdiction has been challenged, and what the court does beyond this is void if you continue, and you cannot lawfully proceed. . You are beyond the ninety day limit of ORS l.050 that you must answer questions before the court within ninety days or give a written reason for the delay, which has not happened. You refused to answer and tried to dismiss my motion, and there are mandated prison sentences for failure to answer or if you try to fabricate a document to appear that you have filed for an extension. You will answer to the people.

Get this, the cult was able to convince certain Navy JAG officers that I had lied to get into the Navy in 1980, that I was a homosexual Satanic ritualist and that I was still married to one of the members of the cult when I really wasn't. Hard to believe they actually got a Navy JAG officer to forge my name to confessions to crimes that are physically impossible to commit, but they did. It also caused some Navy JAG officers to spend some years investigating me to see if I was a homosexual.

In the evening, most Iraqi families gather together for 'evening tea'. It's hardly as formal as it sounds... No matter how busy the day, everyone sits around in the living room, waiting for tea.Iraqi tea isn't a simple matter of teacups and teabags. If you serve 'teabag tea' to an Iraqi, you risk scorn and disdain- a teabag is an insult to tea connoisseurs. It speaks of a complete lack of appreciation for the valuable beverage.
The exact process of making tea differs from family to family, but, in general, it is a three-stage process. First, a kettle of water is put on the burner to boil. Next, the boiling water and a certain amount of tealeaves are combined in a separate teapot and put on a low burner just until the tealeaves rise to the top and threaten to 'boil over'. Finally, the teapot is set on top of the tea kettle on a low burner and allowed to 'yihder' or settle.
There are hundreds of different types of tea available on the market. The best types are from Ceylon. Tea is so important in Iraq, that it makes up a substantial part of the rations we've been getting ever since the sanctions were imposed upon the country. People drink tea with breakfast, they drink tea at midday, they drink tea in the evening and often drink tea with dinner.
Our tea in Iraq is special because it is flavored with cardamom and served in 'istikans'. Istikans are little glasses shaped like the number '8', but open at the top, and flat at the bottom. They are made of thin glass and sit in little glass saucers- or porcelain saucers with intricate designs drawn on them. The color of the tea has to be just right- clear, yet strong- preferably a deep reddish-brown color.

The discussion isn't actually about Turkish troops, per se: it revolves more around the Puppets and their ability, or lack thereof, to convince the CPA what a bad idea introducing Turkish troops into Iraq would be. Iraqis of different ethnicities all have different opinions of late, but this is one thing we all seem to be agreeing upon- Turkish troops will only make the situation worse.There are all sorts of reasons why people don't like the idea of Turkish troops in the region. First, there's a lot of animosity between the Kurds and Turks; thousands of Kurds faced constant persecution while on Turkish territory- many of them were driven into Iraq. Ever since the beginning of the war, there have been several clashes between Kurdish militias and Turkish troops in northern Iraq.
Second, everyone knows that Turkey has certain interests in the region- namely, Kirkuk and Mosul. Turkey has been overly eager to send in troops ever since the 'end' of the war in April.
Third, Shi'a are adamant about not allowing Turkish troops into Iraq because Turks are predominantly Sunni and the thought of an aggressive Sunni army makes the majority of Shi'a nervous.
One faction of Christian society in Iraq, Armenian-Iraqis, are dead set against having Turkish troops in Iraq. They speak of Turkish occupation, bloodshed, executions and being driven into Iraq. Armenian-Iraqis are horrified with the thought of having Turkish troops inside of Iraq.
Then there are all of the historical reasons. For almost 400 years, Iraq was ruled by the Ottoman Empire.... The Ottoman Rule in Iraq ended in 1918, with the start of the British occupation. Iraqis haven't forgotten that during World War I, hundreds of thousands of Iraqis were forced to fight and die for the Ottoman Empire.
