It has been brought to my attention that sometimes this blog is somewhat negative. In my younger days I was actually able to get guys from WW II to talk about some of their experiences. They hate talking about their experiences.
So in order to educate some people about the most optimistic generation and the greatest generation I urge people to buy The Greatest Generation by Tom Brokaw.

I'm going to shove two subjects into one post. The first subject will be the Pledge of Allegiance and the second subject will be Same Sex Marriage. Edwin J. Pole II of Hillsboro, Oregon has written two essays, one about the Pledge of Allegiance and one about Marriage and the State.
The following is an excerpt from an essay written by Edwin J. Pole II about the Pledge of Allegiance.
There are two flaws to the pledge that have caused much difficulty. The inclusion of "under God" has caused much of the controversy. More subtle but more important is that the pledge is primarily to the flag. The "Republic for which it stands" and the principles under which the Republic was founded come as afterthoughts. These flaws left the pledge open to challenge by atheists and even some religionists who strictly interpret a prohibition against idol worship. It has also added to an unfortunate tendency by patriots to mistake the flag for the country and has allowed political charlatans and jingoists to wrap themselves in the flag to deflect criticism.Despite what many would have us believe, we are a secular nation. We are not "under God" except as a choice we are free to make as individuals. We are guaranteed a republican form of government at the national and state levels by the US Constitution. The indivisible nature of the union has been settled politically, legally, and on the battlefield although the sovereign nature of each state is still accepted. The liberty of the individual citizen is enshrined in the very marrow of our understanding of the nature and purpose of government. We represent equal, unbiased justice as a figure with a blindfold.
The pledge should be changed to eliminate the lately-added, lamented reference to god. It was inserted by a cowardly Congress, under pressure from a religious organization, at a time when we were faced by a dangerous challenge from an inimical power based on another religion, Communism. The reference to the flag should be eliminated and replaced by that to which we should be pledged. These are the indivisible Republic and it's fundamental principles; individual liberty and equal justice. In this spirit, the pledge should be changed as follows.
"I pledge allegiance to the Republic of the United States of America and to the principles for which it stands; one indivisible nation of sovereign states with individual liberty and equal justice for all."
The following is from one of my posts about the Pledge.
I received the following email about a silly effort to keep a phrase in the Pledge of Allegiance. I don't pay much attention to the Pledge because I figure if a person is really patriotic then that person will treat all Americans with respect and dignity. When I see people saying the Pledge it reminds me of what Jesus said:JESUS' TEACHING ABOUT PRAYER (St. Matthew 6:5-8) Jesus said, "When you pray, do not be like the hypocrites! They love to stand up and pray in the houses of worship and on the street corners, so that everyone will see them. I assure you, they have already been paid in full. But when you pray, go to your room, close the door, and pray to your Father, who is unseen. And your Father, who sees what you do in private, will reward you."In other words, the Pledge is ridiculous. It's ridiculous with the phrase "Under God" and it's ridiculous without that phrase. I'm glad the Ninth Circuit took out that phrase. Saying the Pledge does not make anybody patriotic. Check out "A History of the Pledge".
The second excerpt is from an essay by Edwin J. Pole II entitled "Marriage And The State".
Review of MarriageMarriage suffers from a dichotomy, especially in the West, and, most especially, in the US. On the one hand marriage is a religious concern. It is defined and solemnized within the context of a religion. The rules and restrictions of marriage are encompassed within the strictures of the religion. The sixth commandment forbids adultery. The ninth forbids coveting another's wife although reading the text implies that the wife is property. A minister, priest, or rabbi solemnizes the marriage in a ceremony.
One the other hand, the state considers marriage to be a contractual relationship. The “Lectlaw” web site1 defines marriage as "a contract" between "a free man and a free woman". The definition includes restrictions of ability and freedom to contract. However, this is a definition under common rather than statutory law. The US Constitution does not mention marriage at all. US Code restricts the application of US law in some cases to those marriages between a man and a woman (Defense of Marriage Act)2.
At least 37 states have passed “Defense Of Marriage Acts” (DOMAs) limiting marriage to between those of opposite sexes3. The Massachusetts Supreme Court has declared that the state statute doing this violates the state constitution. San Francisco has begun issuing marriage licenses to same sex couples in violation of California state statute. Gay rights organizations support changes in laws to allow same-sex marriage and to extend family benefits to same-sex couples. Many corporations offer family benefits to same-sex, unmarried couples while denying these same benefits to opposite-sex couples.
All this has sparked an inflammatory debate between supporters of "traditional" marriage and those who desire change. This debate can be settled by understanding that there need not be a conflict between the religious and secular or state view of marriage. Following the traditional separation of church and state, sacramental or religious nature of marriage can be preserved and those in a religion may freely follow their own rules. The state can keep the definition of marriage as a contract and may perform its legitimate function of enforcing the contractual relationship. In fact, this could make traditional marriage stronger as the religious rules could be placed in the contract and then be legally enforced. This would, at the same time, preserve "traditional" marriage and allow newer, less traditional forms of marriage, or civil unions, to be tried in a stable, enforceable manner.
I, personally, do not see why same sex marriages should not be allowed. If a marriage contract is between two consenting adults, then why not let two members of the same sex enter into a marriage contract?
There seems to be a thread that runs between the two essays by Mr. Pole and I think that it concerns how the state manages to get itself involved in issues that maybe it shouldn't be involved in.
NPR : Justice Blackmun's Papers
Justice Harry Blackmun's papers were recently released and NPR's Nina Totenberg and Linda Greenhouse of the New York Times were given advance access. Blackmun left a collection of more than a half-million letters, notes, memos and journals that provide a fuller portrait of him and offer insights into the life of the court during the last quarter of the 20th century.
I would imagine a lot of people would like to check out the papers just to get an idea of how SCOTUS really works.

Financial management problems at the Pentagon continue to prevent the federal government from earning a passing audit.The government's fiscal 2003 audit looks much like the previous year's: all but three of the 23 agencies covered under the 1990 Chief Financial Officers Act earned clean audits. But, as in fiscal 2001 and 2002, "serious financial problems" at the Defense Department held the rest of the government back, said Comptroller General David Walker in a Feb. 27 letter to President Bush and Congress.
The Pentagon received a disclaimer, or failing mark, for fiscal 2003. GAO will not be able to grant the government a passing mark until Defense cleans up its books, Walker warned.
"Overhauling Defense's financial management operations represents a challenge that goes far beyond financial accounting to the very fiber of Defense's range of business operations, management information systems and culture," Walker said in his letter. "Defense's financial management problems are pervasive, complex, long-standing and deeply rooted in virtually all business operations throughout the department."
Looks like the Pentagon accounting system is stll a mess. Straightening out the books at the Pentagon must not be a high priority.

Until a month ago the only time I could speak in court, on the record, was when I was being tried on groundless criminal charges for contempt of court. Not one of the charges I have made against the thieving attorneys or corrupt judges, in open court, about their involvement in stealing the Kettleberg estate, has been denied or otherwise refuted. What I have come to realize is that the court system in Oregon is completely corrupted. What the Gastons and I and hundreds of other citizens around the state are doing is what Art. I Sec. I of the Oregon Constitution gives us an absolute right to do, namely reform the corrupt government to force observance of the citizens rights to equal protection of the law and due process of law.

Omaha.com has a story about the military's perceived need for more permanent troops.

And his wife is just like countless spouses.
She's growing tired of the separation, even though she, too, is in the Nebraska Guard and remains excited about his mission.
"He's ready to come home, and I'm ready for him to come home," Genine Hovick said Friday. "Enough is enough."
The Pentagon's dependence on the Guard and Reserve is a key reason that Sen. Chuck Hagel, R-Neb., and a fellow military veteran anticipate introducing legislation this week to boost the permanent Army force by 30,000 troops.
It's a controversial idea. Defense Secretary Donald Rumsfeld is sure to resist it. But many of the families of the 182,000 Guard and Reserve troops called to serve full time are likely to express support, and their views could shape Congress' reaction.
Currently, many Guardsmen cannot retire because they have been ordered to stay on duty, even as their families are pressuring them to leave when they can.
The issue will be front and center Tuesday at a Senate Armed Services Committee's personnel subcommittee meeting.

We definitely need more permanent Army regulars. We also need more sailors to completely man the ships we have, much less the ones coming up.
From what I understand we also need more Air Force guys. And the Marines are always looking for a few good men.
I think it's about time the nation realizes it needs more manpower for all the services, not only for the war but in order to completely comply with our responsibilities under existing treaties.

Former narcotics investigator jailed Bryan Nutt's passion for so many years was taking drug dealers off the streets.But as he stood before 3rd District Court Judge Jim Parsons in September, he admitted what so many who cared about him knew: Drugs, which he once loathed, had grabbed hold of him and destroyed much of the life he had built.
Nutt, the former Henderson County Sheriff's narcotics investigator, was sentenced to 10 years probation and ordered confined to a felony substance abuse treatment center for six months, ending a yearlong court battle. He pleaded guilty to six counts of using fraudulent means to obtain controlled substances.
Nutt testified at the hearing, telling the court a recurring back injury got him started using pain killers. The use became more frequent, he said, until it reached a point he was running out of pills well before he was supposed to. That addiction, as his testimony showed, graduated to his use of methadone, cocaine and methamphetamine.
He said he hit his lowest point when he was suspended from the Henderson County Sheriff's Department late last year. He resigned his position after being indicted for drug charges in December 2002. At his September hearing, he said he no longer wants to be a peace officer.

In my opinion (this is my blog so I can put my opinion here) computer voting has too many bugs in the software and issues with the hardware to be a valid indicator of who votes for who or who votes for what. The bugs are in all software, including open source software. However, I could be wrong so check out the following:

Here in Oregon we've solved all those problems by having mail ballots.
By the way, I disagree with this analysis of vote-by-mail ballots in Oregon because there is a stated belief that vote-by-mail was supposed to bring in more voters and if it fails this objective, then the whole process should be questioned dubiously and then discarded.
While some may think bringing in more voters is a laudable goal, I don't believe that this was the primary goal. I believe the primary goal was to make voting easier for those who want to vote and to make accuracy in the ballot count easier to verify.
I think voting-by-mail is the way to go.
The marriage licenses being given out to gay folks in Multnomah County is bringing out the lunacy in some people. The Multnomah County Commissioners have received some hate phone calls and threatening phone calls.
Here in Washington County there are some people who have a homophobia bordering on delusion. For example there is one looney female who is convinced I'm a homosexual. A little over a year ago she came over to where I live and screamed at me to quit being a homosexual and then said she was going to have me arrested. I'm not gay, but even if I were there is no law against being gay.
Of course, this same woman runs around with a few of her female friends and puts spells on people and houses.
My eldest daughter (age 15) is over for the night. Tomorrow I have to take her to the dentist. Since she was quite young she has been taught by some psychos to hate me. Apparently, it has worked
The first thing the did when she walked in the door was insult me and tell me I didn't care about her or love her.
This is what the psychos have been telling her and she believes them.
By the way, one of the psychos called a cop in the Beaverton City Police Department and told him I was causing popups to appear on her computer. I wrote a post about it and it is here. Believe it or not the cop called me and told me I was under investigation for causing popups to appear on the computer.

Porphyrogenitus has a post entitled "America's 21st Century Foreign Policy, Summing & Clarification " that's quite interesting. In the post he has all the links to the various posts that lead up to his summation.
I think it's quite a remarkable piece of work. Take an afternoon off and read his thesis. I went and reread a bunch of his postings just to make sure I had an accurate idea of what Porphyrogenitus was trying to do as he summarized his thesis.
He makes sense and he explains it in such a way that even I can understand it.
I will offer one little opinion. Going through all those links was a pain in the ass. I hope he eventually publishes some sort of index where finding each post is a bit easier.
Porphyrogenitus has made an index. Now, in my humble opinion, he should put a link to the index on the side of his website.
He has also decided to go into the Army. Because he's been out of the National Guard for more than four years, he's got to go through Basic Training again. Aaaaarrrggggghhhhhh. I went through Boot Camp once and that was enough to last me for the rest of my life. Going through Basic Training twice is more than a person should have to endure. Let's wish him well.
The Volokh Conspiracy is controversial once again.
Man, I'm telling you, those conspirators are always getting themselves involved in this or that controversy.
Now we find out from Crooked Timber that the conspirators are causing controversy by merely being. That's right, merely being.
There also seems to be a question about what the Volokh Conspiracy really is. I know and I'm going to tell you, and you don't even have to pay me money for this scoop. I'm going to put the secret of the Volokh Conspiracy in italics because, well, I just like italics.
The true reason the Volokh Conspiracy exists is to take over all the punk rock clubs in LA in order to turn them into bookstores where Randy Barnett can meet groupies.
I know, I know, sleaze of this magnitude should be hidden from the public but this is, after all, a really sleazy blog.
The loonies are getting loonier. I just got a call on the telephone tonight, around 8: PM, from an officer with the Beaverton Police Department. It seems one of the female loonies called up the Beaverton Police Department and accused me of causing popups to appear on a website whenever she uses her computer.
I didn't really understand what the officer meant but I believe he said I was causing popups to appear on the female looney's website. I don't think the female looney even has a website, but if she does, I'm not the one causing the popups to appear. It's probably the hosting company's fault.
Further inquiry reveals the female looney has a Hotmail account. Apparently, Hotmail now has popups.
Anyway, the officer went on to say that if I didn't quit causing the popups to appear he would come out and arrest me for telephonic harassment. I tried to tell him that what the looney was accusing me of was impossible for me to do. I don't own any servers and there is no way I could cause popups to appear on her computer from my computer. I could put popups on my website if I wanted to, but I detest popups and won't put popups on my website. Besides, even if I did put popups on my website and she visited it, it still couldn't be considered telephonic harassment.
The officer then told me he would send out some computer experts to check the computer to see if I had a program on the computer that could cause popups. He then asked me to go check the computer to see if there was anything on the computer that could cause popups to appear on the complainant's computer. I did, but there was no program on the computer in this house that could cause popups to appear on the complainant's computer.
So now I sit, waiting to see if I'm going to be popped for telephonic harassment.
By the way, the loonies have been going to various police agencies for the last twenty years and falsely accusing me of the most outrageous crimes, a lot of them supernatural crimes and, believe it or not, they have actually managed to get some cops to waste a lot of time investigating me for crimes that are impossible to commit.
From the Oregon State Statutes - ORS 166:
166.065 Harassment. (1) A person commits the crime of harassment if the person intentionally:(a) Harasses or annoys another person by:
(A) Subjecting such other person to offensive physical contact; or
(B) Publicly insulting such other person by abusive words or gestures in a manner intended and likely to provoke a violent response;
(b) Subjects another to alarm by conveying a false report, known by the conveyor to be false, concerning death or serious physical injury to a person, which report reasonably would be expected to cause alarm; or
(c) Subjects another to alarm by conveying a telephonic, electronic or written threat to inflict serious physical injury on that person or to commit a felony involving the person or property of that person or any member of that person’s family, which threat reasonably would be expected to cause alarm.
(2) A person is criminally liable for harassment if the person knowingly permits any telephone or electronic device under the person’s control to be used in violation of subsection (1) of this section.
(3) Harassment is a Class B misdemeanor.
(4) Notwithstanding subsection (3) of this section, harassment is a Class A misdemeanor if a person violates subsection (1) of this section by subjecting another person to offensive physical contact and the offensive physical contact consists of touching the sexual or other intimate parts of the other person. [1971 c.743 §223; 1981 c.468 §1; 1985 c.498 §1; 1987 c.806 §3; 1995 c.802 §1; 2001 c.870 §2]
Even if I could cause popups on the female looney's computer, I don't see how it could be telephonic harassment.
These are the same loonies who send emails to the authors of the blogs on my blogroll telling them how evil, nasty and disgusting I am. I've seen a couple of the emails and they usually start out with "I've got to tell you about John" or "You need to know what John's really like." Then the rest of the email consists of false allegations, slander, lies and the usual nonsense. It's the same stuff they've told some of the women I've gone out with and even some of the relatives of some of the women I've gone out with.
These are also the same loonies who have told mass quantities of people, including my two daughters and their mother, that I'm part of an intergenerational Satanic cult that does all sorts of magical atrocities and murders.
On an unrelated note: Oregon has outlawed abusing the national and state flag.
166.075 Abuse of venerated objects. (1) A person commits the crime of abuse of venerated objects if the person intentionally abuses a public monument or structure, a place of worship or the national or state flag.(2) As used in this section and ORS 166.085, "abuse" means to deface, damage, defile or otherwise physically mistreat in a manner likely to outrage public sensibilities.
(3) Abuse of venerated objects is a Class C misdemeanor. [1971 c.743 §224; 1995 c.261 §2]
